The Regular Meeting of the Borough of Raritan Council was held on September 14, 2010 at the Municipal Building,
22 First Street, Raritan, NJ 08869 at 8:33 pm.
Mayor Jo-Ann Liptak presided and stated: Notice of this meeting has been made by advising the
Somerset Messenger Gazette and The Courier News of the time, date and place of this meeting, posting a notice on
the official bulletin board, filing a copy in the Borough Clerk’s office and including this statement in the minutes.

the Clerk’s Office after making your comments.
Mike Lopez, Plainfield Avenue: He expressed his concern about safety issues raise in the September 7, 2010
article in the Messenger-Gazette regarding the Willow Walk development.
Mayor Liptak responded to his concerns and stated that due on-going litigation she could not respond to all
his questions.
Vera De Losh, 716 Foothill Road, Bridgewater: Stated her concerns regarding the parking issues due to the
Char Steakhouse. She is especially concerned with the anticipated increase in parking during the holiday season.
Council President read the two police reports on the traffic studies conducted in the Char area.
Richard Bartolucci, 12 Second Street: He inquired about the River front park property line dispute.
Mr. Bartolucci believes the hole on the property is a safety hazard.
Mark Anderson responded about his review of the deeds in question and the matter is still pending.
Jim Foohey, 710 Rhine Blvd.: He spoke about the video he made on the possible expansion of Canal Street Park.
Mr. Foohey also noted a parking issue in the park area.
Councilman Victor Laggini and Councilman Greg Lobell asked for copies of the video.
Mike Lopez, Plainfield Avenue: He then expressed his opinion on the handling of anonymous complaints and his view
on the destruction of public documents, signed or anonymous.
Mayor Liptak responded to his concerns.
ORDINANCES: PUBLIC HEARING AND FINAL ADOPTION

Council President Denise Carra moved and Councilman Victor Laggini seconded the opening of the public hearing on
Ordinance 2010-08. Motion carried.

AN ORDINANCE AMENDING CHAPTER 73 ENTITLED “STREET OPENINGS” TO INCREASE PENALTIES FOR VIOLATIONS OF THIS CHAPTER
BE IT ORDAINED by the Borough of Raritan, County of Somerset, State of New Jersey, that Chapter 73 of the
Borough Code entitled “Street Openings” is hereby amended as follows:
SECTION ONE:
Section 73-19 entitled “Violations and penalties.” is hereby amended in its entirety to read as follows:
§ 73-19. Violations and penalties.
Any person, persons, or entities violating any of the provisions of this Chapter shall, upon conviction thereof,
pay a fine of not more than $2000 for each offense or be imprisoned in the county jail for not more than 90 days
or perform community service for not more than 90 days. Each twenty-four hour period that the violation continues
shall constitute a separate and distinct offense. Any member of the Police Department, Property Maintenance Office
or Public Works Department of the Borough shall be and is hereby authorized to issue a summons or violation notice
upon his or her belief that probable cause exists for such issuance.
SECTION TWO:
This Ordinance shall take effect upon its final passage and publication according to law.

Council President Denise Carra moved and Councilman Greg Lobell seconded the opening of the public hearing on
Ordinance 2010-09. Motion carried.
Jim Foohey, 710 Rhine Blvd.: He questioned the minimum fine imposed by the ordinance.
Mayor Liptak replied that the ordinance only sets the maximum fine and that the presiding judge would assess the
minimum fine on a case by case basis.

AN ORDINANCE REPLACING SECTION 52-7 OF THE RARITAN BOROUGH CODE ENTITLED “CERTAIN TYPES OF LOITERING
PROHIBITED” WITH A PROHIBITION ON SLEEPING IN PUBLIC PLACES
BE IT ORDAINED by the Borough Council of the Borough of Raritan in the County of Somerset that the Code of the
Borough of Raritan of 1966 and heretofore amended be further amended as follows:
SECTION ONE:
Section 52-7, which section is entitled “Certain types of loitering prohibited”, is amended in its entirety
to read as follows:
§52-7. Use of public places for sleeping or habitation prohibited.
A. For the purposes of this section, “public place” shall mean any place to which the public has access,
including but not limited to any street, sidewalk, curb, alley, highway, bridge, park, school, place of worship,
public building, public grounds, parking lot, transportation facility, open or vacant private property, or
the doorways or entrance ways to any building which fronts on any of the aforesaid places, or a bench, chair,
or seating area in or on any of the aforesaid places.
B. No person shall sleep in any public place, nor shall any person use any motor vehicle or trailer for
sleeping or habitation purposes in any public place.
SECTION TWO:
This Ordinance shall take effect upon its final passage and publication according to law.

RESOLUTION - SOCIAL AFFAIR PERMIT
Councilwoman Maureen Wilson moved to approve the following resolution and was seconded by Councilman Greg Lobell.

WHEREAS, a Social Affair Permit application has been filed for a wine tasting to be held at the St. Ann School
Cafeteria on Saturday, November 6, 2010, from 6:00pm - 10:00pm to serve alcoholic beverages; and
WHEREAS, that the Chief of Police has no objections to the filing of said application; and
WHRERAS, the Borough Clerk has certified that not more than 25 Social Permits have been authorized for these
premises during this calendar year and the appropriate fee has been paid;
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Raritan that the Borough Clerk be
authorized to sign said application and forward same to the Department of Law & Public Safety, Division of

WHEREAS, the Administrator has informed the CFO that the purchaser of a monthly parking decal sticker
has returned the unused portion of the sticker and has requested that his/her money be refunded.

COMMITTEE REPORTS
Council President Carra reported the tax collection rate, the municipal court, the car wash, building department and
environmental commission. She noted the nine recipients of the curb appeal awards.
Councilman Laggini offered the fire department reports and reported that Meet Your Neighbor Day will be held
October 10th from 12:00 p.m. – 4:00 p.m. He noted that October 3rd – 9th is Fire Prevention Week.
Councilwoman Wilson reported for the Board of Health and the Somerset County Health Department. She noted that
there will be no more rabies clinics left in Raritan for the remainder of the year. Councilman Wilson noted that
William DeSantis, who recently entered the Marine Corp. and family, will attend the Marine Band Concert as her guest.
Councilman Lamaestra offered the Department of Public Works report.
Councilwoman Gara offered the following reports:
Chamber of Commerce – The Chamber would like to invite all residents to join them this Friday, September 17 from
7 pm – 11 pm to celebrate Raritan’s 62nd Anniversary as a Municipality. The Block Party will be between Anderson
and Thompson Streets and will feature Dominique, Julian and Lou. Dominique will entertain you with music from
Celine Dion, Whitney Houston, Aretha Franklin, Natalie Cole, Pat Benatar, Sarah Brightman and many more. Julian is a
versatile performer to name a few Nat and Natalie Cole, Frank Sinatra, Willy Nelson, Elvis, Barry White, Steve Wonder,
Louis Armstrong and Lou has to be seen and heard to be believed. Rod Stewarts’ double he will entertain us from
American Classics to Rock and Roll. There will be Moon Walk activities for children and refreshments available for
purchase. Please bring your friends and family and join us for this wonderful night out.
The Chamber would also like to invite you to join in the 2nd annual Fun Run and the newly added 5K River Bank Run on
Saturday the 25th registration will begin at 9 am at the Basilone Statue. The run will begin promptly at 10:30 and our
very own Lisa Simenta will be singing God Bless America. Come down for a fun day filled with many other activities.

Police – On August 23 the Raritan Borough Police Department (Lt. Robert Ludwig) assisted the Somerset County Sheriff’s
Department in a joint effort referencing a CHILD CAR SAFETY SEAT INSPECTION at Washington School between 2 pm and 6 pm.
The Sheriff supplied numerous officers from their agency who are trained Safety Seat inspectors for this detail.
On this date 26 vehicle Child Car Safety Seats were both removed and reinstalled or new installations were completed
by the Sheriffs Staff. Each inspection takes approx. 2o min. to complete. Despite the weather being rainy it was
still a huge success. Joint efforts will be planned to continue with this program in the future. Safety for our
children is our number one concern and the loss of any life is not acceptable.
Police Activity Report for the Month of August – Responded to 892 GC, 62 MV Accidents, 125 moving summons.
Anyone interested in seeing a full report may obtain one directly from the police department.
Sgt. David Malina checked the intersections throughout the borough and complied a list of intersections that either
needs new striped painted areas or the striping that exists needs to be redone. A copy of this list was also placed
with DPW liaison Councilman Lamaestra.
Planning Board – The Planning Board will be meeting on Wednesday, September 22, 2010 at 7:30 pm. The Board will be
hearing the Amended Willow Walk application any resident interested is welcome to attend.
Councilwoman Stefanie Gara made a motion to approve the State Absence from Meeting policy. The motion was seconded
by Councilman Greg Lobell. Upon call of the roll, motion was unanimously approved.

PUBLIC COMMENTS
Vera De Losh, 716 Foothill Road, Bridgewater: Inquired about the time line for the Police Department conducting
the traffic studies.
Chief Mark Ciesla responded that the traffic studies would be conducted in a timely manner.
Anthony De Cicco, 10 Anderson Street: He stated his belief that Councilwoman Wilson votes based on
political party lines.
Councilwoman Wilson declined to respond to his comments.
